Contract Review: Our initial step in every conveyancing purchase involves a thorough review of the contract to spot any unfair terms or unexpected elements.

During this review, we assess various components, including the property’s specifics such as the sale price, deposit requirements, and items included or excluded from the sale. We also carefully examine any special conditions set by the seller, along with the standard general terms and conditions. Additionally, we inspect the certificate of title to ensure there are no title defects, caveats, easements, or covenants that might impact your use of the property or your ability to make future modifications. We also review any government disclosure documents included in the contract.

After completing our review, we provide you with our industry-leading written advice – which explains the whole conveyancing process in an easy-to-digest format, the key dates for your purchase and all of the key considerations for your purchase.

Negotiate any Changes to the Contract: In the course of our contract review, we might suggest changes to specific terms within the contract. If you agree with our recommendations, we will communicate with the seller’s lawyer to make those adjustments.

Assist with the Signing and Exchange of Contracts: After you are content with the contract and the seller has accepted your offer, the next step in the conveyancing process typically involves signing and exchanging contracts, as well as paying a deposit. We can assist with this process, although it is often handled by the real estate agent. 

Undertake Pre-settlement Checks: Between the exchange of contracts and settlement, we will liaise with the seller’s lawyer on your behalf to resolve any issues that may occur. Additionally, we will work with your incoming bank/lender and broker to ensure all their requirements are met before settlement.

We will also communicate with the local council, strata (if applicable), and local water utility provider to determine any outstanding balances related to the property, ensuring these are all paid by the seller at the time of settlement.

Stamp Duty Grants and Applications: We can assist with the preparation and submission of stamp duty grants and applications on your behalf including any first home owner grants/concessions.

Prepare for and Attend to Settlement: On settlement day, we will organise for the financial settlement to be completed (i.e., payment of the full purchase price and stamp duty) and for all title documents to be digitally lodged and registered with the relevant state registry via PEXA. Once settlement is completed, you can collect your keys!

Post-Settlement: We will provide you with a final purchase letter, which includes all the key information for your purchase and any important documents to hold onto.
