What does our Denham Court Conveyancing Service involve?
At Hindsight Legal Advisers, we provide full-service legal assistance throughout your buying and selling journey – from contract negotiation/preparation right through to settlement. Our Denham Court Conveyancing Service offering includes the following for purchase matters (for more information on our sale offering, this can be accessed here):
Contract Review: Our first step in every conveyancing purchase is to conduct a comprehensive review of the contract to identify any unfair terms or unexpected elements.
In this review, we evaluate various aspects, including the property’s details such as the sale price, deposit requirements, and items included or excluded from the sale. We also scrutinize any special conditions imposed by the seller, along with the standard general terms and conditions. Additionally, we examine the certificate of title to ensure there are no title defects, caveats, easements, or covenants that could affect your use of the property or your ability to make future modifications. We also assess any government disclosure documents included in the contract. Once our review is complete, we provide you with our industry-leading written advice.
Negotiate any Changes to the Contract: During our contract review, we may recommend modifications to certain terms within the contract. If you agree with our suggestions, we will liaise with the seller’s lawyer to implement those changes.
Assist with the Signing and Exchange of Contracts: Once you are satisfied with the contract and the seller has accepted your offer, the next step in the conveyancing process usually involves signing and exchanging contracts, along with paying a deposit. We can assist with this process, although it is often managed by the real estate agent.
Undertake Pre-settlement Checks: Between the exchange of contracts and settlement, we will communicate with the seller’s lawyer on your behalf to address any issues that may arise. Additionally, we will collaborate with your incoming bank or lender and broker to ensure all their requirements are fulfilled before settlement.
We will also communicate with the local council, strata (if applicable), and local water utility provider to determine any outstanding balances related to the property, ensuring these are cleared by the seller at the time of settlement.
Stamp Duty Grants and Applications: We can assist with the preparation and submission of stamp duty grants and applications on your behalf including any first home owner grants/concessions.
Prepare for and Attend to Settlement: On settlement day, we will organise for the financial settlement to be completed (i.e., payment of the full purchase price and stamp duty) and for all title documents to be digitally lodged and registered with the relevant state registry via PEXA. Once settlement is completed, you can collect your keys!
Post-Settlement: At the conclusion of your matter, we will supply you with a final settlement letter, which contains all the essential information for your purchase or sale and any important documents to retain. This can be shared with your accountant and will make tax time easier for you in the future.
