At Hindsight Legal Advisers, we provide full-service legal assistance throughout your buying journey – from contract negotiation right through to settlement. Our conveyancing service offering includes the following:
Contract Review: Our first step for every conveyancing purchase is to review the contract to make sure there are no unfair terms or surprises.
Our review will consider a number of different matters including the details of the property (for example, sales price, deposit payable, what is included/excluded from the sale, etc), the special conditions that the seller has included in the contract (in addition to the standard general terms and conditions), the certificate of title to ensure that there no title ‘defects’, caveats, easements or covenants that may affect your use of the property or your ability to make changes to the property in the future, and any government disclosure documents included in the contract. Once our review is completed, we will present you with our industry-leading written advice
Negotiate any Changes to the Contract: As part of our contract review, we may recommend that certain terms in the contract be changed. If you accept our recommendations, we will then engage with the seller’s lawyer to have those changes made
Assist with the Signing and Exchange of Contracts: If you are happy with the contract and have had an offer accepted by the seller, the next step in the conveyancing process is usually for contracts to be signed and exchanged and for a deposit to be paid. We can assist with this, though often it is the real estate agent that will organise this
Undertake Pre-settlement Checks: Between exchange of contracts and settlement, we will continue to engage with the seller’s lawyer on your behalf (including to resolve any issues if they arise) and will also liaise with your incoming bank/lender and broker to ensure all of their requirements have been satisfied ahead of settlement.
We will also liaise with the local council, strata (if applicable) and local water utility provider to understand what balances remain outstanding in relation to the property and ensure these are paid by the seller at settlement
Stamp Duty Grants and Applications: We can assist with the preparation and submission of stamp duty grants and applications on your behalf
Prepare for and Attend to Settlement: On settlement day, we will organise for the financial settlement to be completed (i.e., payment of the full purchase price and stamp duty) and for all title documents to be digitally lodged and registered with the relevant state registry via PEXA. Once settlement is completed, you can collect your keys!
Post-Settlement: We will provide you with a final purchase letter, which includes all the key information of your purchase and any important documents to hold onto. This can be provided to your accountant and will simplify tax time for you.
